Hello, and welcome to our Terms and Conditions, which describe all the rules that apply when you decide to use our services or our website. By booking with us, you automatically agree that you accept our rules and regulations. Hence it is very important that you read and understand our terms and conditions before applying to one of our workations.
The terms ‘Flaks’, ‘we’, ‘us’, ‘our’ are used to indicate the organizers of the program and the expressions ‘Flakser’, ‘you’, ýour’ stand for the participants.

When you book any of our programs, you agree to all our terms and conditions, therefore we kindly ask you to read our rules carefully before joining our Flaks workations.
Your application is considered confirmed when you get a booking confirmation from us after paying the reservation fee. In case there is no reservation fee applicable, then your application is confirmed after fulfilling the full invoice. After receiving the invoice with the full amount your spot will be reserved for 14 days. If the invoice is not fulfilled within those days your spot will be open to book by others again.
The deposits (reservation fee) paid are non-refundable.
We reserve the right to deny any application for any reason.
The reservation of the accommodation is secure on the moment that the full invoice has been paid. As the number of participants is limited, in the event of too many applications we will look at the date and time of the moment the money was received. We reserve the right to cancel the application of the participants that paid later. These participants will in that case receive a full refund.
Cancellation by Flaksers
Flaksers may cancel their trip in writing at [email protected]. The cancellation is effective after our confirmation email. Depending on the date of cancellation, Flaksers may be entitled to a partial refund with the following conditions:
> 60 days: The reservation fee is held as cancellation;
60 days – 31 days: 33% of the price is held as cancellation;
30 days – 15 days: 67% of the price is held as cancellation;
14 days – 0 days: 100% of the price is held as cancellation.
No refund is possible in case of no show.
If a participant does not want to take part in an organized and included event or does not want to use the provided facilities during the program, that participant is responsible for the costs and organization of any alternatives.
Cancellation by Flaks
Flaks reserves the right to cancel the workation at any time and for any unforeseen reason. In the event of cancellation, Flaksers will get a full refund.
We also have the right to cancel a participant’s place at our program if full payment is not received.
In case of changes in the dates or the location Flaks will give the Flaksers the option to still participate or to get fully refunded. The previously provided contact information will be used to notify every participant about any changes as soon as possible.
It is your responsibility to make sure that you are in possession of all necessary health and travel documents before the start of the program.
You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel destination and ensure that you carry all necessary vaccination documentation. In some cases, failure to show required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country. It is highly recommended that you consult with your local doctor, travel medical service or specialist vaccination clinic before departing.
A full and valid passport and Visas may be required for our destinations. Requirements may change and it is your responsibility to confirm them prior to booking with the consulate or Embassy in which you are intending to travel.
The participants are not insured by the organizer. The participants are obliged to insure that they have sufficient health, travel and accident insurance coverage (including sport coverage).
Participation in activities during our program is at your own risk. Good health is a prerequisite for all activities. The participant shall undertake to inform the organizer of any health problems.
In the case of adventure activities, the following health conditions in particular exclude participation: hypertension, pregnancy, heart disorders, cardiovascular, neck or back problems, prior injuries, epilepsy as well as chronic ear disorders with impaired sense of balance.
It is the duty of the Flakser to abide by the conditions for participation and to strictly follow the instructions given by the organizer, the support personnel or the instructor.
For water activities (windsurfing, kitesurfing, etc.) participants must be able to swim.
We retain the right to film, record or photograph any attendees for post-event and marketing purposes. You agree that, while participating in any of our programs, images, photos or videos may be taken by other participants, the organizer or its representatives that may contain or feature you. You consent to any such pictures being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to Flaks, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
We reserve the rights to all staff photography and video footage during our program. Participants are only allowed to use these for their own personal use, and have no right to record, copy, commercially exploit, communicate to the public or distribute in any way the materials of the event.
We are not responsible for damage, loss or theft of personal items.
We are not responsible for any kind of personal injury that occurs during or after your stay with us.
We are not responsible for loss of income caused by unforeseen circumstances, like a fallout of the electricity or internet. Flaks will take good care of the circumstances so that the chance of such an event happening is as small as possible.
We are not responsible for your tax return. The Flaksers decide themselves which costs are tax-deductible and which are not.
Flaks is permitted to revise these Terms and Conditions at any time as it sees fit, and by using this website and our services, you are expected to review our terms on a regular basis to ensure you understand all terms and conditions governing the use of our website and services.

We use the “visitor action pixels” from Facebook Inc (1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”)) on our website.
This allows user behavior to be tracked after they have been redirected to the provider’s website by clicking on a Facebook ad. When someone visits www.flaks.co we use a third party service, Google Analytics, to collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make any attempt to find out the identities of those visiting our website.
We use the Google Analytics service from Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”) to analyze our website visitors. Google uses cookies. The information generated by the cookie about the use of the online product or service by users is generally transferred to a Google server in the USA and stored there. Google will use this information on our behalf to evaluate the use of our online products and services by users, to compile reports on the activities within these online products and services and to provide us with further services associated with the use of these online products and services and the use of the internet. Pseudonymous user profiles can be created from the processed data.
We use Google Analytics only with IP anonymization enabled. This means that Google will truncate the IP address of users within Member States of the European Union or in other states that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.
The IP address transmitted by the user’s browser is not merged with other Google data. Users can prevent cookies from being stored by adjusting the settings to their browser software accordingly.

When you purchase a ticket (or tickets) through the Flaks website, your name, address data, email and provided content in the fields of the application (such as the information that you would like to have on your invoice, etc) will be stored in Autorespond. Please be assured that we do not share your personal details with any other company unless it is necessary for organizing our event. You can always change the data you have provided via a self-service link provided in our newsletter.
When you use the internet provided during our events, we do not monitor, collect or store any of your browsing data.
